These Terms of Service apply to all users of the Truly Khana website and services, including customers who place orders through our platform. By accessing our website or placing an order, you agree to be bound by these terms.
TERMS & CONDITIONS

Orders
1.1 Orders must be placed before Wednesday 11:59 PM for Sunday delivery.
1.2 Once this cut-off time has passed, orders are final and cannot be modified, cancelled, or rescheduled.
1.3 We reserve the right to accept, decline, or cancel any order at our discretion, including where we suspect fraudulent activity, incorrect pricing, or operational constraints.

Product Availability and Substitutions
2.1 All menu items are subject to availability.
2.2 Where an item becomes unavailable after an order is placed, we may substitute it with a similar product of equal or greater value or remove the item and provide a refund for that item.

Pricing and Payment
3.1 All prices are listed in Australian Dollars (AUD) and include GST where applicable.
3.2 Payment must be made in full at the time of ordering.
3.3 Payments are processed securely via third-party providers such as Stripe.
3.4 Truly Khana does not store or have access to your full payment details.

Delivery
4.1 We currently deliver to the Lower North Shore and Eastern Suburbs of Sydney.
4.2 Deliveries take place on Sundays between 9:00 AM and 1:00 PM.
4.3 Delivery times are estimates only and may vary due to factors outside our control.
4.4 Customers may provide delivery instructions, including authority to leave the order unattended.

Unattended Deliveries
5.1 By providing authority to leave, you acknowledge and accept that your order may be left unattended.
5.2 Once the order has been delivered in accordance with your instructions, it is deemed fulfilled.
5.3 Truly Khana is not responsible for theft, damage, or spoilage of items after delivery.

Failed Deliveries
6.1 If delivery cannot be completed due to incorrect, incomplete, or inaccessible delivery information, or unsafe conditions at the delivery location, we may leave the order in a reasonable location or cancel the delivery.
6.2 In such cases, refunds may not be provided.

Risk and Title
7.1 Risk in the products passes to you upon delivery.
7.2 You are responsible for ensuring that products are stored safely and in accordance with food safety guidelines immediately after delivery.

Food Safety and Storage
8.1 Meals are delivered fresh unless otherwise specified.
8.2 Some items, including but not limited to samosas, may be delivered frozen.
8.3 Customers must refrigerate or freeze products promptly upon delivery.
8.4 Fresh meals should be consumed within 4 days if refrigerated and may be frozen for longer storage.
8.5 Truly Khana is not responsible for any issues arising from improper storage or handling after delivery.

Allergens
9.1 Our products may contain or come into contact with common allergens including nuts, dairy, gluten, and others.
9.2 While we take reasonable care in preparation, we cannot guarantee that our food is free from cross-contamination.
9.3 Customers with allergies or dietary requirements consume our products at their own risk.

Limitation of Liability
10.1 To the maximum extent permitted by law, Truly Khana is not liable for any indirect, incidental, special, or consequential loss or damage arising from the use of our products or services.
10.2 Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law.

Third-Party Platforms
11.1 Truly Khana products may, now or in the future, be made available through third-party platforms such as delivery marketplaces.
11.2 Orders placed through such platforms may be subject to additional terms and conditions imposed by those providers.

12.2 You must not engage in any activity that may disrupt or interfere with the operation of the website or its services.
